General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to all orders placed via our online shop amalphis.at, operated by Amalphis PS GmbH, Donau-City-Straße 3, Office 1, 1220 Vienna, Austria.

§ 2 Contracting Party

The sales contract is concluded with:

§ 3 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking the "Buy" or "Complete Order" button, you place a binding order. Confirmation of receipt of the order is sent immediately after sending by an automated email. This email does not yet constitute an acceptance of your offer. A sales contract is only concluded through an express order confirmation or by delivery of the goods.

§ 4 Prices and Payment

All prices quoted are final prices including the statutory value-added tax. Any additional delivery and shipping costs will be stated separately in the respective product description and during the ordering process. From an order value of €35, we deliver free of shipping costs to Austria, Germany, Switzerland, and Poland.

The following payment methods are available to you: Credit card, PayPal, Klarna, Apple Pay, Google Pay.

§ 5 Delivery

Delivery to Austria, Germany, and Switzerland takes place within 2–3 working days after receipt of payment to the delivery address provided by you. We deliver to Austria, Germany, Switzerland, and Poland. Shipping is carried out via DHL, DPD, or Austrian Post, depending on the delivery address.

§ 6 Retention of Title

The delivered goods remain the property of Amalphis PS GmbH until full payment has been received.

§ 7 Warranty

The statutory warranty rights apply. In the event of defects in the goods, please contact us by email at info@amalphis.at.

§ 8 Liability

We are liable without limitation for intent and gross negligence. For slight negligence, we are only liable in the event of a breach of essential contractual obligations and only for foreseeable damage typical of the contract.

§ 9 Applicable Law

Austrian law applies, excluding the UN Sales Convention. The place of jurisdiction is Vienna, provided the customer is a business entity.

§ 10 Final Provisions

Should a provision of these T&Cs be invalid, this does not affect the validity of the remaining provisions.
