General terms and conditions

§ 1 Scope

These general terms and conditions apply to all orders placed through our online shop amalphis.at, operated by Amalphis PS GmbH, Donau-City-Straße 3, Office 1, 1220 Vienna, Austria.

§ 2 Contracting party

The purchase contract is concluded with:

§ 3 Formation of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking "Buy" or "Complete order", you place a binding order. Receipt of the order is confirmed by an automatic email immediately after submission. This email does not yet constitute acceptance of your offer. A purchase contract is only formed upon express order confirmation or delivery of the goods.

§ 4 Prices and payment

All stated prices are final prices including statutory VAT. Additional delivery and shipping costs are shown separately in the relevant product description and during checkout. For orders of €35 or more, we offer free shipping to Austria, Germany, Switzerland and Poland.

The following payment methods are available: credit card, PayPal, Klarna, Apple Pay and Google Pay.

§ 5 Delivery

Delivery to Austria, Germany, and Switzerland takes place within 2–3 working days after receipt of payment to the delivery address you provide. We deliver to Austria, Germany, Switzerland and Poland. Shipping is via DHL, DPD or Austrian Post, depending on the delivery address.

§ 6 Retention of title

The delivered goods remain the property of Amalphis PS GmbH until payment has been received in full.

§ 7 Warranty

Statutory warranty rights apply. If the goods are defective, please contact us by email at info@amalphis.at.

§ 8 Liability

We accept unlimited liability for intent and gross negligence. In cases of slight negligence, we are liable only for breaches of essential contractual obligations and only for foreseeable damage typical of the contract.

§ 9 Applicable law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Vienna is the place of jurisdiction if the customer is a business.

§ 10 Final provisions

If any provision of these terms and conditions is invalid, this does not affect the validity of the remaining provisions.
